Permeateq collaborates with various third-party vendors and service providers to enhance our offerings. We not only develop our own software solutions but also provide comprehensive system support and maintenance services. When we encounter clients with existing software systems, we extend our support and maintenance expertise to ensure optimal performance. These Third-Party Terms outline our engagement with external providers and explain how their services integrate with our software and support solutions.


1. Scope of Services

Permeateq offers:

Software Solutions: Custom-developed or white-label software applications.

System Support and Maintenance: Comprehensive IT support, including preventive maintenance, troubleshooting, and system optimization for both our software and clients’ existing systems.

We work with a range of trusted third-party vendors to enhance and deliver these services.


2. Use of Third-Party Services

To complement our software solutions and system support, we integrate or rely on third-party services in Kenya, which may include:

Cloud hosting and data storage providers

Hardware suppliers and peripheral vendors

Software libraries and application programming interfaces (APIs)

Payment gateways and financial transaction systems

Cybersecurity platforms and monitoring tools

These third-party integrations help ensure that our software and support services perform at the highest standards.


3. Acceptance of Third-Party Terms

By engaging with Permeateq, you also agree to the terms and conditions of any third-party providers whose services are incorporated into our solutions. These may include licensing agreements, data processing agreements, and service-level agreements (SLAs) imposed by those providers.


4. Liability for Third-Party Services

Permeateq is not liable for any direct delays or losses solely attributable to third-party platforms, unless otherwise explicitly stated in a separate agreement. We select partners that meet rigorous performance and security criteria to ensure the best support for our clients’ software and system maintenance needs.


5. Third-Party Software and Integrations

When third-party software or integrations are utilized as part of our solutions:

Clients must adhere to all licensing and usage rights imposed by the original third-party provider.

Unauthorized use, reproduction, or distribution of third-party software is prohibited.

Permeateq will provide support and maintenance for the integrated system as per the agreed service levels, but any issues originating exclusively from the third-party component may be subject to that provider’s terms.


6. Data Sharing and Confidentiality

To deliver integrated software and support services, it may be necessary to share certain data with our third-party partners. This data is shared under strict confidentiality obligations and solely for the purposes of enhancing service delivery. Third parties are prohibited from using this data for unrelated purposes.


7. Service Interruptions and Third-Party Dependencies

While we strive to ensure uninterrupted service:

Any service disruption or failure due to third-party dependencies is managed by close coordination with the respective vendor.

Clients will be promptly informed about any issues and the steps being taken to resolve them.


8. Vendor Security and Compliance

All third-party vendors are required to comply with our security standards and all applicable laws and regulations, including those related to data protection and IT security in Kenya. This ensures that all integrated services meet the high-security benchmarks expected by our clients.


9. Changes to Third-Party Providers

Permeateq reserves the right to modify or change third-party service providers as necessary, without prior notice, provided that such changes do not adversely affect the quality or continuity of the software and system support services provided.
